Developers are eyeing up land at 3 Bull Street, in West Bromwich, for the new homes.
A planning application, submitted to Sandwell Council on August 7, is seeking permission for a "change of use of first floor from restaurant to self-contained flats".
Planning bosses will decide on the plans at a future date.
A previous application, submitted in 2013, was granted to demolish an existing building at the site for "reconstruction of a mixed use development including retail, restaurant and five apartments", planning documents show.
