Murder accused, 22, believed victim was abusing his mother

A murder suspect believed his alleged victim was abusing his mother before he went "berserk" and violently attacked him, a trial heard.

Daman Sehra, 22, told jurors he "saw red" after Amjad Khan, 32, attended his mother's flat in Yardley Close, in Oldbury, on June 8 last year, Wolverhampton Crown Court was told.

Sehra's uncle, Derek Brennan, 32, who also attended the flat, is accused of murder too.

Sehra, who had been drinking that day, repeatedly struck Mr Khan on the head with a glass bottle and child's toy, leaving him blooded and with head injuries, the court heard. Mr Khan died five days later in hospital.

Sehra, who denies murder, said he visited his mother, Lisa Sehra, to see if "she was alright", adding: "I was contacted a few weeks ago by police saying there had been domestic violence with my mother as the victim."

Before Mr Khan visited the flat, Sehra overheard a phone conversation between his mother and a male which made him "angry and upset", jurors heard.

The case so far:

Balraj Bhatia QC, defending Brennan, then asked Sehra: "When this person came through the door, what was your initial reaction to him?"

Sehra, of no fixed address, replied: "I just went mad. It was what he was saying to my mom, the way he spoke to her."

Mr Bhatia asked Sehra if this showed a "gripe" between him and the person "using and abusing his mother", to which Sehra replied: "Yes."

In further cross examination, Sehra said he "went berserk" and "saw red" before admitting: "I attacked him".

Sehra said it was never his intention to kill or harm Mr Khan, but added: "I was picturing him and mom doing drugs stupidly together. He was taking the p***."

Caroline Haughey QC, defending Sehra, said Sehra carried out a series of internet searches after the attack where he searched for "Yardley Close" and "Smethwick".

Sehra replied: "I knew it was a serious fight. I wanted to know if he was alright."

He was arrested after the attack. Once in custody, the court heard Sehra was asked to provide a DNA sample, which he refused.

Sehra said: "My solicitor wasn't present. If I knew he had died, I would have definitely given a DNA sample."

Sehra has pleaded guilty to manslaughter on the grounds of diminished responsibility and actual bodily harm. However, he denies grievous bodily harm.

Brennan, of Halesowen Road, Netherton, has pleaded not guilty to murder, manslaughter, grievous bodily harm and actual bodily harm.

The trial continues.
