Brierley Hill takeaway owner banned after admitting to 12 hygiene offences

A former director of a Brierley Hill takeaway has been banned from being involved in the running of a food business after being sentenced at Wolverhampton Crown Court

Kuljit Baines has been handed a 33-week imprisonment sentence (suspended for 18 months) and was ordered to pay £1,000 towards costs, after pleading guilty to 12 food hygiene offences.

Dudley Council brought the prosecution under the Food Safety and Hygiene Regulations 2013, after Burger ‘N’ Grill on Brierley Hill High Street was closed two times in six months due to rat activity.

Bains, aged 47, of Ivy House Lane, Coseley, was the sole director of Burger ‘N’ Grill Ltd and pleaded guilty to the offences during a Walsall Magistrates trial in September.

 The case was then referred to the Crown Court for sentence because of the seriousness of the offences.

Following an application from Dudley Council,  Bains is prohibited from participating in the management of any food business for a minimum of 18 months.

Councillor James Clinton, cabinet member for health and wellbeing, said: “I am pleased to hear the outcome of this legal case, which should serve as a reminder to anyone who runs food premises that they must comply with the standards expected.

“Our environmental health officers found serious breaches of legislation on visits to Burger ‘N’ Grill in August 2022 and again in February 2023. 

"On both occasions we forced the takeaway to temporarily shut, using emergency powers, as the conditions presented an imminent risk to consumers’ health due to rat activity.”

The Burger ‘N’ Grill premises have ceased trading, and the Limited Company has been dissolved.
