Dudley murder accused admits having knife in his hand - but claims it was 'for protection'

A man who is on trial for the murder of his uncle in Dudley said he genuinely believed he was going to be killed when he was attacked by him in a kitchen.

Annib Khan, aged 29 and from New Road, Netherton is on trial for the murder of Mohammed Osman Khan, a 45-year-old father of four, outside a house in Buffery Road, Dudley on June 21 last year. 

The prosecution say he plunged a kitchen knife into Mohammed Osman Khan's neck after a struggle outside the property. Annib Khan denies murder.

A jury at Wolverhampton Crown Court heard a prepared statement to police from him in which he admitted having a knife during a struggle in the kitchen just before the alleged attack outside.

The court heard the struggle involved Annib Khan, Mohammed Osman Khan and his son Zayn Khan.

The statement read: ""I genuinely believed this attack was going to kill me and picked up a knife from near the kitchen sink and 'waved it to scare' Mohammed and Zayn.

 "I was pushing Mohammed away from the house to get him to leave. He was still swearing at me."

The statement continued, saying he told them to leave but was dragged to the front of the house where he still had the knife in his hand and made contact with Mohammed Khan.

He said: "As soon as this happened, I ran into the house, fell on the kitchen floor and passed out."

Zayn Khan, aged 21 of Warren Hall Road, Dudley - is standing trial alongside Annib Khan and denies a single count of affray.
