The Health and Safety Executive will not go for a re-trial of Richard Leek, who was on duty as Adrian Miles lay at the bottom of the Walsall campus of Wolverhampton University. The lifeguard denied a breach of duty at work by failing to take reasonable care of pool users and was on trial for three weeks.
A jury at Wolverhampton Crown Court was discharged after failing to reach a verdict following almost 10-and-a-half hours of deliberations last week.
The HSE could have sought a re-trial against the 31-year-old of Broad Lane South, Wednesfield. Fellow on-duty lifeguard Alex Cotterill was fined £200 after being convicted of the same offence during the trial.
