A hoodie who was videoed "happy slapping" a teenager outside Lichfield's Garrick Theatre has failed in a bid to have a two-month detention sentence overturned.

Dismissing Luke Walker's appeal against the decision of Tamworth Magistrates earlier this month Miss Recorder Diane Cotton QC, sitting with two magistrates, described the offence as "despicable."

She heard that the victim, a 15-year-old boy, went to theatre on March 16 with his girlfriend and at the interval went outside for some air.

Mr Patrick Sullivan, opposing the appeal, said Walker was nearby with a group of about 10 men.

The victim heard one of the group say "keep the video running" and moments later was slapped over the head and across the face by Walker.

Walker, aged 18, of Curborough Road, Lichfield, admitted a charge of common assault when he appeared before the magistrates.
