Six men avoid jail for brawl at store

Six men who were part of a brawl in a convenience store involving a knife and a golf club have been spared jail.

A row broke out over a leaking lager can at Saver Express on Birmingham New Road, Tipton, Wolverhampton Crown Court was told.

Brothers Mohammed Nadeem, Mohammed Hussain and Asif Hussain, who run the shop, were set upon by Jamie Chilton, Roger Flute and Robert Flute, the court heard.

Roger Flute had arrived at the shop on February 27 last year carrying a knife, while his sibling Robert, came brandishing a golf club. They had come to support Chilton who had complained about a leaking can hours earlier.

The court was told that a fight broke out among the six men during which Robert Flute was seen with a golf club.

There were also numerous blows thrown towards Chilton with Mohammed Hussain seen stamping on his head. His brothers Asif and Mohammed Nadeem also rained blows onto Chilton and Robert Flute.

During interviews Roger Flute said he had a knife on him as a form of protection. Robert Flute claimed he found the golf club on the way to the shop.

Mohammed Hussain, aged 34, of Yew Tree Lane, Yardley, was sentenced to 16 months in prison, suspended for two years, for affray.

Mohammed Nadeem, 32, of Market Place, Great Bridge, was given a 40-week sentence suspended for two years for affray. Asif Hussain, 30, of Barrows Road, Sparkhill, was also given 40 weeks suspended for two years for affray.

Jamie Chilton, 34, of Queen Street, Tipton, admitted common assault and was told to carry out 120 hours of unpaid work. Robert Flute, 38, of Sycamore Road, Tipton, pleaded guilty to affray, he was sentenced to 26 weeks, suspended for two years. Roger Flute, 48, of Lewis Street, Tipton, was given a four-month sentence suspended for two years for possession of a knife.
