Yesterday's judgement may put the brakes on a proposed alteration of the Steve Bull Stand, which would see the number of seats in the stadium increase to 34,500.
The first £16m phase of Molineux plans – which will up capacity to just over 31,000 – is already under way and is expected to completed in the summer.
But Mr Moxey said the next phase is now under review because of the affect the ruling on pubs is expected to make on the number of fans going to watch games live.
It comes after he revealed pubs illegally showing Wolves games on TV before yesterday's ruling had led to a 2,500 drop in average attendance.
"We have to make a decision as to whether we're going to press ahead with the new Steve Bull Stand," said Mr Moxey.
"And, in light of the decision at the European Court of Justice, it's going to be a slightly more interesting debate that we're going to be having as to whether we say yes or no."
